Payments:
VyeEyewear.com accepts PayPal and most major debit/credit card companies. We currently do not accept international debit/credit cards (with the exception of Canada).
All orders are subject to a security check prior to shipment. When submitting an order, the payment will run an address verification check with your financial institution to confirm the billing and shipping information provided. When placing your order, please make sure that you use the billing address and contact information as it appears on your credit statement. It is recommended that your order be shipped to the billing address for quicker processing. If shipping to an alternate address, delays may occur as additional verification with the customer may be needed to confirm the authorized transaction. Please be advised that our security checks are intended to ensure the safety of your financial information and to prevent unauthorized use of your PayPal and debit/credit cards. Any orders that do not pass the AVS/security check will not be processed.
If your credit card is declined, a message will appear on the page with the reason why it was declined. If it is declined as a result of an AVS mismatch, please verify that the billing address information you are entering on the website is an exact match to the billing address information on file with your credit card issuing bank. If your card is declined as a result of the card code mismatch, please ensure that you are correctly entering the 3 or 4 digit code that appears on the front or back of your card (varies by card type). If your transaction is otherwise declined, please ensure that you have sufficient funds available in your account to complete the transaction, or contact your bank to inquire about any holds that may have been placed on your card.
Declined transactions may appear on your billing statement as pending transactions. Within 3-5 business days, your bank will remove these pending transactions from your account. These funds are not being held by VyeEyewear.com, and may have their pending status removed only by your bank.
Tax Information
Sales tax is only applicable to orders shipping to the state of California.
User Restrictions
You understand and accept that all information, data, images, graphics, buttons, photographs, graphics, video, audio, and other material that appears on this Site are owned by Vye Eyewear or its licensors. You are expressly prohibited from using any of the aforementioned content from the VyeEyewear.com site without the express written consent of Vye Eyewear or its licensors. None of the material may be reproduced, distributed, displayed, re-used, posted, transmitted, downloaded, or copied in any form or method without prior written consent of Vye Eyewear and the appropriate licensor. Permission to use materials on the Site is only granted for personal, non-commercial use provided that no modifications are made to the materials and that all copyright and other proprietary notices in the materials are retained. You may not “mirror” any material contained on this Site. Any permission granted terminates automatically without any further notice if you breach any of the above terms. Upon this termination, you agree to immediately destroy any downloaded and/or printed materials. Any unauthorized use of materials contained on this Site may violate domestic and/or international copyright laws, privacy or public laws, and communication regulations.
Limitation of Liability
Vye Eyewear will not be liable for any damages, either direct or indirect, incidental or consequential, for use of or inability to use material, products, or services of any kind, delay of or partial delivery, termination of rights or loss of profits, data, business or goodwill, whether on a contractual or extracontractual basis, or to provide indemnification or any other remedy to you and/or to any third party. Your sole and exclusive remedy is to discontinue using and accessing this website. Because certain federal, state, or provincial laws do not allow the exclusion or limitation of certain damages, these exclusions may not apply to you.
Failure on the part of Vye Eyewear to enforce any provisions of these terms or to respond to a breach by you or any third party of these terms shall not in any way waive Vye Eyewear’s right to at a later time enforce any of the terms and conditions contained in our policies or act with respect to related issues.
